1 Subject of the License and Acceptance

The "Reef Guru" application (hereinafter "the Work") is an intellectual work of a creative and technical nature, protected under Italian Copyright Law (Law of April 22, 1941, no. 633) and international copyright treaties.

The activation of the "Reef Guru Premium" license does not constitute the provision of a service (SaaS), but represents a temporary grant of the economic exploitation rights of the Work. By using the Work, the user agrees to these Terms.

2 Payments and Royalties

• Nature of Payment: The amounts paid are to be understood as Royalties for the license to use the Work.
• Automatic Renewal: The license automatically renews at the end of each period (monthly or annual) unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Management: The renewal cost will be charged to the payment method associated with the user's account (Google Play Store or Apple App Store).

3 Cancellation

Users can manage their license and turn off auto-renewal through their Store account settings. Cancellation takes effect at the end of the current license period. No refunds are provided for partially used periods.

4 Absolute Exclusion of Liability; User Responsibility

• Nature of Information: Guidance on livestock compatibility, chemical treatments, and calculations (Alkalinity/KH, Calcium/Ca, Magnesium/Mg, NO3/PO4) consists of general guidelines and DOES NOT constitute professional advice.
• Bugs and Calculation Errors: The user is solely responsible for any treatment or chemical addition performed in their aquarium. The Author is not liable for damages resulting from software bugs or mathematical glitches.
• Manual Verification Requirement: The user must manually verify any calculated dosage against independent sources (product labels, test kits, professional consultation) before implementation.

5 Privacy and "Offline-First" Policy

Reef Guru is designed as an offline-first application to maximize the protection of user data.

• Local Processing: Data (parameters, photos, notes) is stored exclusively in the local database of the device. The Author does not maintain external servers for collecting or selling aquarium data.
• Internet Connection: Network access is strictly limited to license validation through the Stores and, optionally, encrypted backups on the user's personal cloud (e.g., Google Drive).
• Biometric Data/Photos: Any photos or biometric access are managed entirely by the device's operating system and are never transmitted to the Author.

6 Disclaimer of Warranties

The Work is provided "as is" and "as available." The Author does not guarantee the continuity of updates or corrective maintenance, which remain at the Author's sole discretion.

7 Limitation of Liability

To the maximum extent permitted by law, the Author shall not be liable for:

• Property damage (including total loss of fish, corals, or technical equipment).
• Personal injury or incidental damages arising from software bugs.

8 Legal and Tax Nature

This agreement is governed by the rules on Copyright. The Author does not exercise an organized commercial activity, does not have a business structure, does not offer remote assistance services, and does not provide professional consultancy. The software performs every calculation exclusively locally on the user's device.

9 Governing Law and Jurisdiction

These terms are governed by Italian law. For any dispute relating to the use of the Work or these Terms, the exclusive jurisdiction shall be the Court of Bari (Italy).

1 Oggetto della Licenza e Accettazione

L'applicazione "Reef Guru" (di seguito "l'Opera") è un'opera intellettuale di natura creativa e tecnica, tutelata dalla Legge italiana sul Diritto d'Autore (L. 22 aprile 1941, n. 633) e dalle convenzioni internazionali sul diritto d'autore.

L'attivazione della licenza "Reef Guru Premium" non configura la fornitura di un servizio (SaaS), bensì rappresenta una concessione temporanea dei diritti di sfruttamento economico dell'Opera. Utilizzando l'Opera, l'utente accetta i presenti Termini.

2 Pagamenti e Royalty

• Natura del Pagamento: Gli importi versati dall'utente sono da intendersi come corrispettivo (Royalty) per la licenza d'uso dell'Opera.
• Rinnovo Automatico: La licenza si rinnova automaticamente alla scadenza di ogni periodo (mensile o annuale), salvo disattivazione del rinnovo automatico almeno 24 ore prima della scadenza del periodo corrente.
• Gestione: Il costo di rinnovo verrà addebitato sul metodo di pagamento associato all'account dell'utente (Google Play Store o Apple App Store).

3 Disdetta

Gli utenti possono gestire la propria licenza e disattivare il rinnovo automatico tramite le impostazioni del proprio account Store. La disdetta ha effetto alla scadenza del periodo di licenza corrente. Non sono previsti rimborsi per i periodi parzialmente utilizzati.

4 Esclusione Assoluta di Responsabilità; Responsabilità dell'Utente

• Natura delle Informazioni: Le indicazioni su compatibilità tra animali, trattamenti chimici e calcoli (inclusi ma non limitati a: Alcalinità/KH, Calcio/Ca, Magnesio/Mg, NO3/PO4) costituiscono linee guida generali e NON costituiscono consulenza professionale.
• Bug ed Errori di Calcolo: L'utente è l'unico responsabile di qualsiasi trattamento o aggiunta chimica effettuata nel proprio acquario. L'Autore non è responsabile per danni derivanti da bug software, errori di codice o imprecisioni matematiche negli algoritmi.
• Obbligo di Verifica Manuale: L'utente è strettamente tenuto a verificare manualmente qualsiasi dosaggio calcolato confrontandolo con fonti indipendenti (etichette dei prodotti, kit di analisi per titolazione, consulenza professionale) prima dell'implementazione.

5 Privacy e Politica "Offline-First"

Reef Guru è progettata come applicazione offline-first per massimizzare la protezione dei dati dell'utente.

• Elaborazione Locale: I dati (parametri, foto, note) sono archiviati esclusivamente nel database locale del dispositivo. L'Autore non mantiene server esterni per la raccolta o la vendita di dati degli acquari.
• Connessione Internet: L'accesso alla rete è strettamente limitato alla validazione della licenza tramite gli Store e, opzionalmente, ai backup crittografati sugli spazi cloud personali dell'utente (es. Google Drive).
• Dati Biometrici/Foto: Qualsiasi foto o accesso biometrico è gestito interamente dal sistema operativo del dispositivo e non viene mai trasmesso all'Autore.

6 Esclusione di Garanzie

L'Opera è fornita "così com'è" e "come disponibile". L'Autore non garantisce la continuità di aggiornamenti o manutenzione correttiva, che rimangono a discrezione esclusiva dell'Autore come revisioni periodiche dell'Opera.

7 Limitazione di Responsabilità

Nella misura massima consentita dalla legge, l'Autore non sarà responsabile per:

• Danni materiali (inclusa la perdita totale di pesci, coralli o attrezzatura tecnica).
• Lesioni personali o danni incidentali derivanti da bug software.

8 Natura Giuridica e Fiscale

Il presente accordo è disciplinato dalle norme sul Diritto d'Autore. L'Autore non esercita un'attività commerciale organizzata, non dispone di una struttura d'impresa, non offre servizi di assistenza remota e non fornisce consulenza professionale. Il software esegue ogni calcolo esclusivamente in locale sul dispositivo dell'utente.

9 Legge Applicabile e Foro Competente

I presenti termini sono disciplinati dal diritto italiano. Per qualsiasi controversia relativa all'uso dell'Opera o dei presenti Termini, il foro competente in via esclusiva sarà il Tribunale di Bari (Italia).
